ESSENTIAL HOME INSPECTION SERVICE
INSPECTION AGREEMENT
1. SCOPE OF INSPECTION. Essential Home Inspection Service agrees to perform a visual inspection of property located at __________________________________________________________________ and provide a written inspection report. This report is intended only as a general guide to assist the client in making his/her own evaluation of the overall condition of the home. The purpose of the inspection is to identify major, visually observable defects which are present at the time of inspection, and which might affect the use of the property for its intended purpose. This inspection is limited to readily accessible areas of the property.
2. INSPECTION FEE. Client agrees to pay Essential Home Inspection Service a fee of $_______________ for inspection of the above referenced property. Any liability of Essential Home Inspection Service shall be limited to the amount of the inspection fee.
3. SYSTEMS COVERED. This inspection is limited to the following systems and/or components:
Attic Basement Built-In Appliances Central Air Conditioning
Crawl Space Drainage Electrical Exterior
Fireplace Foundation Heating Insulation
Interior Plumbing Roof Materials of Construction
4. SYSTEMS NOT COVERED. The following items are not covered in this inspection:
Cesspools Central Vacuum Systems Detached Buildings
Drain Fields Intercom Systems Low Voltage Systems
Personal Property Playground Equipment Pools
Security Systems Septic Tanks Solar Heating Systems
Sprinkler Systems Trash Compactors Tennis Courts
Underground Utilities Water Softeners Wells
5. LIMITATIONS. No disassembly of equipment, opening of walls, moving of furniture, appliances or stored items are required of the inspector. No excavations will be performed. All components and conditions which by the nature of their location are concealed, camouflaged or difficult to inspect are excluded from the report. The presence of fresh paint is a considerable inspection limitation. Thermostats and timers are not checked for accuracy or calibration. Air conditioners can not be checked when the temperature is below 65 degrees. Pressure gauges are not used to test air conditioners. Only the ability of the dishwasher to fill and drain properly will be checked. Garbage disposals are checked for operation only.
6. ENVIRONMENTAL EXCLUSIONS. Inspections will not address the possible presence or danger from asbestos, lead paint, urea formaldehyde, toxic or flammable chemicals, water or airborne related illness or disease.
7. UNFORSEEN REPAIRS. Every home has many identical components (electrical outlets, windows, bricks, etc.). A representative sample of these components will be inspected, therefore, some deficiencies which were detectable may go unnoted.
8. PESTS. This inspection does not include an examination to identify the presence of wood boring insects such as termites, carpenter ants, powder post beetles or carpenter bees. This inspection additionally will attempt to identify any visual major structural damage caused by such insects. This inspection will not identify the presence of rodents or other vermin.
9. NO WARRANTY. This inspection report is not intended as a warranty, guarantee or insurance policy. Essential Home Inspection Service makes no expressed or implied warranty of merchantability or fitness for use regarding the condition of the property and it should not be relied upon as such. Any expressed opinions regarding adequacy, capacity or expected life of components are general estimates based on information about similar components and occasional wide variations are to be expected between such estimates and actual experience.
10. BINDING ARBITRATION. Any dispute, controversy, interpretation or claim including claims for, but not limited to, breach of contract, any form of negligence, fraud or misrepresentation or any other theory of liability arising out of, from or related to, this contract or arising out of, from or related to the inspection or inspection report shall be submitted to final and binding arbitration “under the rules and procedures of the Expedited Arbitration of Home Inspection Disputes of Construction Arbitration Services, Inc.” The decision of the Arbitrator appointed thereunder shall be final and binding and judgment on the Award may be entered in any Court of competent jurisdiction.
11. EXCLUSIVE USE. Client acknowledges that the inspection report is intended for the client’s sole, confidential and exclusive use and possession. This report may not be copied or otherwise reproduced without written consent from Essential Home Inspection Service.
